Know How To Apply For Australia Employer Nomination Scheme Visas (Subclass 186).

What is Australia Employer Nomination Scheme?

This scheme is for skilled workers that are nominated by the employer so that they are able to live and work in Australia for permanent basis. With the help of this Australia subclass visa 186, its holder is eligible to do the following things:

  • Will be able to live, work and study in Australia indefinitely
  • They can sponsor the eligible family members for the Australia PR
  • If the holder is eligible, they can apply for Australian citizenship.

What are the requirements to be eligible for Employer Nomination Scheme visa (subclass 186)?

Now, for the applicant to be able to apply for the visa, they are required to fulfill some requirements and met the eligibility criteria. Different requirements for the applicant to be applying for Employer Nomination Scheme visa (subclass 186) are as follows:

  • For age, applicant needs to less than 45 years of age at the time of application submission for the visa. Taking about the exemptions for this case, there are only few exemptions for the age requirement.
  • Under the requirement for language, primary applicant is required to show competent ability in English. If the applicant’s sponsoring employer/business has a labor Agreement then the requirement for English competency is lowered.
  • There are some nominated occupations that require mandatory registration, license or professional membership. For example in order to practice as a registered nurse, doctor and other health care professional occupations, it is mandatory to be registered with Australian Health Practitioner Regulation Agency.
  • For primary applicant and any accompanying family members who have applied for the permanent resident visa, they are required to satisfy the health and character requirements.
  • There is also a commitment needed by the applicant that requires them to work in the nominated role for a period of minimum 2 years.
  • Must have received nomination from legitimate Australian employer.
  • Minimum of three years of relevant work experience is required in the same nominated occupation.

What is the requirement for the sponsoring business for Australia ENS subclass 186?

Sponsor business eligible under this program have to fulfill the following requirements:

  • Business has to show that the applicant’s proposed salary is equal to “Australian Market Rate” for the nominated occupation.
  • For the nominated role to be eligible, sponsoring employer has to meet “Australian Market Rate” sponsored role which must be equal to Temporary Skilled Migration Income Threshold (TSMIT).
  • As the applicant had to make the commitment, employers are also needed to make a commitment that ensures that the nominated role is available to the applicant for at least 2 years.
  • The business must have the history of compliance with Australian immigration and workplace relations laws.

What are the different streams under Australia Employer Nomination Scheme visa 186?

To facilitate the applicants, there are three streams under this scheme. These streams are as follows:

Temporary Residence Transition Stream – Stream allows the skilled worker who are currently living and working in Canada by the Temporary Work (Skilled) Visa (Subclass 457) to apply for employer nomination scheme visa 186. For to be eligible under Temporary Residence Transition Stream, applicant must be living and worked in the country for at least two years under the nominated occupation, with the nominating employer now willing to offer permanent job to the applicant. Under this stream the application processing time is approximately of 12 to 18 months. Application processing speed depends upon the application submitted by the applicant.

Direct Entry Stream – Candidates, who are not qualified under Temporary Residence Transition Stream but holds a subclass 457 visas, can apply under this stream. In order to apply for this stream, it is not necessary to be living in Australia, as the applicant can apply from outside the country. Under this stream the application processing time is approximately of 12 to 18 months. Processing speed for the application depends upon the complexity of the application.

Labor Agreement Stream – With this stream, Australian employers are able to sponsor the holder of Temporary Work Subclass 457 via a labor agreement or regional migration agreement. This stream provides with an immigration pathway to candidates who are eligible for permanent residence visa based on skills, age, and language proficiency etc.

What is the application process for the Australia Employer Nomination Scheme subclass visa 186?

Applicants can submit their application for the visa with the help of the Department’s online portal. But in order to start the process of application processing, applicant will first require their employer to start the process to prepare the nomination application for the role, for which online portal can be used. Applicant will require the nomination application TRN which is provided to the employer once they have started their nomination application.

Applicant will be able to submit their application once the employer has submitted the business nomination application. Applicant is not required to wait till Department decides the business nomination application. If the candidate is looking for nomination approval, the applicant is required to submit their application within the period of six months of the date business nomination application is approved. After successfully submitting the application, candidate will be required to submit documents electronically.

What are the fees to apply for the Employer Nomination Scheme subclass visa 186?

Below is the fee that is required to be submitted by the applicants for the Australia subclass visa 186:

  • Australia Subclass visa 186 fees – $540 AUD
  • Visa Primary applicant fees – $3,670 AUD
  • Additional charge for each additional member with 18 years or above age – $1,835
  • Additional charge for each additional member with below 18 years of age – $1,835
