Types of Work Permit in Canada

There are two types of Work Permit in Canada.

Employer-Specific Work Permit

An Employer-Specific Work Permit in Canada allows foreign workers to work for only one specific employer as listed in the permit. This type of permit often comes with conditions, such as the job location, work duties, and duration of employment.

To get an Employer-Specific Work Permit, the employer may need to secure a Labour Market Impact Assessment (LMIA) to show that hiring a foreign worker won’t negatively affect the Canadian labour market. This work permit is suitable for those who have a specific job offer in Canada and plan to work solely for that employer.

Open Work Permit

An Open Work Permit in Canada allows foreign nationals to work for almost any employer and is not job-specific. This permit offers flexibility as it doesn’t tie the worker to a single employer, so they can change jobs or work in different locations.

No Labour Market Impact Assessment (LMIA) is required, making the application process simpler. Open Work Permits are available for specific groups, such as spouses of international students, recent graduates, and participants in special immigration programs. This type of permit provides greater freedom for individuals wanting to work and live in Canada.

Who is eligible for a Work Permit in Canada?

To be eligible for a Canadian Work Permit, you must:

  • Prove to the immigration officer that you will leave Canada when your Work Permit expires.
  • Show that you have enough funds to take care of yourself and your family members during your stay in Canada.
  • Not plan to work for an employer listed with the status “ineligible”.
  • Not intend to work for an employer who offers striptease, erotic dance, escort services or erotic massages.
  • Obey the law and have no criminal background.
  • Not be a danger to the Canadian society.
  • Be in good health.

How to apply for a Work Permit in Canada from India?

The process to apply for a Work Permit in Canada from India can be carried out in 4 easy steps.

STEP 1: Gather documents

Refer to the checklist mentioned below and gather the supporting documents needed to apply for a Work Permit in Canada from India.

  • A valid passport.
  • Two passport-sized photographs.
  • Proof of employment in Canada e.g. LMIA.
  • Proof of education e.g. Diploma or Degree.
  • Proof of relevant work experience.
  • Proof of sufficient funds e.g. bank statements.
  • Copies of marriage and children’s birth certificates for accompanying dependents.
  • Family information form (IMM 5707).

You must provide a certified translation if your documents are not in English or French. You may also need to provide additional documents depending on your circumstances.

STEP 2: Complete the application

When applying for a Work Permit from India, you must fill out and submit these forms:

  • Application For Work Permit Made Outside of Canada (IMM 1295).
  • Document Checklist (IMM 5488).
  • Family Information (IMM 5707).
  • Statutory Declaration of Common-law Union [IMM 5409] (if applicable).
  • Use of a Representative [IMM 5476] (if applicable).
  • Authority to Release Personal Information to a Designated Individual [IMM 5475] (if applicable).

Be complete and accurate. Fill out all the sections and if a section does not apply to you, write “Not Applicable” or “NA”. Do not do these for the name fields. Also, you must sign and date the application wherever necessary.

STEP 3: Pay the fees

The processing and biometric fees for a Canadian Work Permit will not be refunded, no matter the final decision. You may also need to pay additional charges for courier services (if applicable). Furthermore, the fee and currency exchange rate in Indian rupees are subject to change over time. Make sure to check the official Canada Immigration website to know the updated fee. STEP 4: Submit the application

You may send your Work Permit application to a Visa Application Center (VAC) that serves your area - or apply online. Make sure to fill out the Document Checklist [IMM 5488] and include it with your application package.

Once you have submitted your application, Immigration, Refugees and Citizenship Canada (IRCC) will check to make sure that you have submitted a complete application, paid the fee, and have sent all requested supporting documentation.

After you apply

The processing time for a Work Permit for an applicant from India can range from 6 to 28 weeks. The time it takes depends on the type of work permit, the office you applied to, and how complete your application is.

If your Work Permit application is approved, the IRCC will send you an approval letter that says you are allowed to work in Canada. This letter is called the port of entry letter of introduction. You must bring this letter with you when you travel to Canada - and present it at the port of entry.

This letter is not your work permit. You will only get your Canadian Work Permit at the port of entry the day you arrive in Canada.

Preparing for arrival

When you arrive in Canada, you must have:

  • Your passport.
  • Your Visitor Visa or eTA if you need one.
  • Your port of entry letter of introduction.
  • Any travel document(s) that you’re carrying.

Once the border service officer has checked your documents and confirms that you can enter Canada, the officer will print your actual Work Permit for you. Make sure to read the conditions of your Work Permit carefully. If you don’t meet those conditions, you could be asked to leave Canada.
