One of the family reunification options for overseas nationals planning to move to UK with family is the UK Spouse Visa. Overseas nationals can file an application for the UK Spouse/Partner Visa as long as their partner based in the UK:

  • Is a citizen of the UK or Ireland (either by naturalization or by birth)
  • Has settled in the UK with the ILR - Indefinite Leave to Remain status or EU Settled Status
  • Has humanitarian protection or refugee status in the UK
  • Has a Turkish Entrepreneur or Turkish Work Visa

The applicant has to intend to reside together in the UK after immigration to the UK (if overseas). They will also have to offer proof of their authentic and continuous relationship.

Requirements for the UK Spouse Visa

Authentic Relationship Criteria

You will have to prove that you are in a qualified relationship through the following:

  • You are married or in a civil partnership that is recognized in the UK; or
  • Have been residing together in a relationship for a minimum of 2 years; or
  • Intend to get wed or enter into a civil partnership in the UK within 180 days of arrival in the UK

Significantly, UKVI - UK Visas and Immigration would like to assure that your relationship is continuous and authentic. They are ever watchful over the prospective ‘sham’ relationships or marriages. In such cases, applicants state falsely that they are in a qualified relationship while they are not actually.

Financial Criteria

The applicant of the UK Spouse Visa and partner based in the UK has to prove that they possess an annual income of at least £29,000. The latest UK Home Office policy paper specifies that the minimum income criteria for this Visa will continue to increase to £34,500 and eventually reach £38,700.

There will be no longer extra income criteria if the applicant has kids.

Only the below income sources will be accepted:

  • Income from self-employment or employment
  • Pension of the partner and/or applicant
  • Bereavement benefits or maternity allowances received by the partner based in the UK
  • Any extra savings and/or income specified by the partner and/or applicant

The financial criteria for the UK Spouse Visa can also be exclusively fulfilled by cash savings. This is if you have a minimum of available £88,500.

English Language Criteria

The UK Spouse/Partner Visa applicants have to demonstrate adequate familiarity with the English in any of the three ways:

  • Pass a CEFR - Common European Framework of Reference for Languages test in English language from an authorized testing center. It has to be a minimum of A1 level in Writing and Speaking.
  • Later if you intend to extend your stay in the UK, you must be able to demonstrate a minimum A2 Level CEFR to demonstrate continued betterment corresponding to the time you have stayed in the UK.
  • Have a degree or other academic credential with the medium of instruction in the English language
  • Have exemption based on age (above 65 years), or a physical/medical condition or citizenship of - USA, Australia, Antigua and Barbuda, Barbados, the Bahamas Belize, Canada, Dominica, Guyana, Grenada, Jamaica, St Kitts and Nevis, New Zealand, St Lucia, St Vincent and the Grenadines, or Trinidad and Tobago.

Accommodation Criteria

Applicants have to demonstrate having suitable accommodation in the UK which:

  • Occupied or owned exclusively by the applicant and the members of the family
  • Has adequate space for living
  • Fulfills any criteria about public health

The UK Spouse/Partner Visa application process has to be completed on the website of the UK Home Office online as follows:

  • Confirm your eligibility for the UK Spouse/Partner Visa
  • Prepare the required documents to demonstrate your eligibility
  • Complete the application form online
  • Make payment of the application fee
  • Upload documents necessary for supporting your application
  • Book a slot for a biometric appointment to provide your photo and fingerprints
  • If invited, appear for the interview
